On September 4, 2026, the full U.S. Court of Appeals for the 5th Circuit ruled that the Constitution does not guarantee Americans the right to clean drinking water. The decision, decided 10-5, upheld the dismissal of a lawsuit brought by residents of Jackson, Mississippi, over the city's long-running lead contamination crisis.

The court also ruled that public officials have no constitutional duty to tell residents the truth about water safety, even during a public health emergency.

The case centered on lead, but the ruling itself goes far beyond a single danger.

The lawsuit, Sterling v. City of Jackson, was filed in 2022 by four residents who said city officials knew Jackson's water system had serious problems as early as 2010, failed to fix them, and then told residents the water was safe anyway. Testing by the Mississippi State Department of Health between 2010 and 2013 showed lead levels in the city's water rising sharply.

The residents argued this violated their constitutional right to bodily integrity under the 14th Amendment's Due Process Clause. The 5th Circuit, however, disagreed.

In the majority opinion, Judge Kurt Engelhardt wrote that while the deprivation of clean water was "grievous," it did not infringe on any deeply rooted constitutional right, and that no historical or legal tradition supports one.

Five judges dissented, arguing the residents' claims should have at least been allowed to proceed to discovery.

The ruling doesn't just apply to Jackson, and it doesn't just apply to lead either. Here's what it means in practice:

• There's no constitutional right to clean drinking water at all—regardless of the contaminant involved, whether that's lead, PFAS, glyphosate, or any of the 324+ dangers detected in U.S. tap water supplies.

• There's no constitutional duty for officials to tell the truth about water safety, even during a known public health crisis.

• Existing regulations, like the EPA's Lead and Copper Rule, are unaffected—but this ruling narrows the legal options residents have if a local water system fails and officials don't act.

The bottom line is federal environmental law still sets the rules, but if a local government falls short, or misleads the public about water quality, this ruling may make it significantly harder to hold anyone accountable.

2010–2013: Mississippi State Department of Health testing shows lead levels rising in Jackson's water supply.

2022: Jackson residents file suit, alleging the city knowingly allowed lead contamination and misrepresented the water as safe.

2025: A divided three-judge 5th Circuit panel revives part of the residents' case.

2026: The full 5th Circuit agrees to rehear the case, vacating that earlier ruling.

September 2026: The full court rules against the residents, finding no constitutional right to clean water or truthful information from officials.
